Foreseeti AB (“Foreseeti”) will always comply with applicable privacy laws (including the General Data Protection Regulation (2016/679/EC) and national completing laws), as well as ensure that personal data is processed confidentially. Foreseeti will not disclose personal data to third parties without prior consent, unless specifically stated herein. Foreseeti is the data controller of personal data pertaining to our administration of our contacts with customer and potential customers and/or partners and when performing our obligations as regards support and service to our customers.
Foreseeti may process the following personal data:
• Your name, title, and company name
• Contact information, i.e. e-mail address, and phone number
• If you contact Foreseeti, we store correspondence or comments, which may contain personal data, to provide better service if you contact Foreseeti again
Purpose of Processing
Foreseeti provides services and software related to information security. By entering into a license agreement (or other agreement, if relevant) with Foreseeti, certain information regarding the data subject signing the agreement on behalf of the contracting party and/or contact persons for the contracting party will be processed by Foreseeti. Foreseeti may also provide support to the contracting party, whereby name and contact information of employees or consultants may be processed. The personal data is processed for the purpose of effectuating the agreement entered into with Foreseeti and to provide support as agreed between the parties. Further, Foreseeti will process personal data of representatives of existing and potential customers, in order to inform of its products and services for marketing purposes and to respond to requests or questions which is submitted to Foreseeti by e-mail, phone or through its web-site. Legal basis for processing The processing of personal data is necessary for the entering into a contract to which the contracting party is a party or in order to take steps at the request of the contracting party prior to entering into the contract. The processing of personal data is therefore necessary for the purposes of the legitimate interest pursued by Foreseeti as controller of the personal data and the legitimate interests of the contracting party. Those interests override the interest or fundamental rights and freedoms of the data subjects who represents the contracting party in relation to Foreseeti (GDPR art 6.1 f). Further, the processing of personal data is necessary for legitimate marketing purposes, and those interests overrides the interests and fundamental rights and freedoms of the data subjects, whose personal data is processed in their capacity as representatives for their employer (art 6.1 f) . Processing of personal data may also take place for Foreseeti’s business development and in analyses of Foreseeti’s business, e.g. through market analysis and product development. The data which is processed in this way is processed based on our legitimate interest in developing the business and communicating with our contacts, in accordance with article 6.1 f). Foreseeti will further process personal data to the extent that Foreseeti is required to do so by law or decision by a competent authority (GDPR art 6.1 c). The contracting party is the controller of any personal data submitted into the products and/or services.
Lawfulness of Processing
Foreseeti will process your data legally, correctly, and in a transparent manner. We will process your personal data for the stated and legitimate purposes stated in this policy, and we will not process your personal data in any way which is inconsistent with these purposes. Further, Foreseeti collects and processes personal data, which is adequate, relevant, correct and necessary for the purposes for which it is collected and used and only for as long as is necessary for the purposes for which it was collected. Foreseeti will process your data as long as necessary for complying with its obligations with its customers and other contractual partners. Data which is processed for the purpose of developing, analysing, and marketing Foreseeti’s products and services are saved for two years after the most recent contact.
Transfer of Data
Foreseeti will only transfer data to third countries subject to that the transfer is in compliance with the provisions of the GDPR, or in in accordance with applicable law at every given time. Foreseeti will ensure that the personal data has the equivalent protection as that guaranteed within the EU in the event personal data is transferred to a third country.
Foreseeti ensures that appropriate technical and organisational measures are taken to protect your personal data against unauthorised access or destruction, illegal processing or accidental loss or damage. Foreseeti limits access to personal data within the organisation. Authorisation to access personal data is given only to individuals within the organisation, or within a data processor and its sub-processor, for the sole purpose of carrying out their respective duties.
You are entitled to request access to and rectification of personal data as well as erasure of personal data, restriction of processing or object to processing (if in accordance with applicable privacy laws). Furthermore, you have a right of access to the personal data that you have provided in a structured, commonly used and machine-readable format (portability). You also have the right to file a complaint with the supervisory authority, http://www.datainspektionen.se. Further, you have the right to object at any time to processing by Foreseeti for the purpose of direct marketing. You may object by refusing continued direct marketing as directed in Foreseeti’s communications or by contacting us as stated below.
